Pharmacist Dispensed Expired Drugs: What You Need to Know About Your Rights

Discovering that a pharmacist has dispensed expired medication can be both alarming and frustrating. Expired drugs can lose their effectiveness or, in some cases, become harmful. Patients trust pharmacists to provide safe, effective medications, and when that trust is broken, the consequences can be serious. If you’ve received expired drugs, it’s important to understand your rights and take immediate action.

The first step is to stop using the expired medication as soon as you notice the issue. Check the packaging for the expiration date and keep the bottle or container as evidence. Consult your doctor immediately, especially if you suspect that the expired drug has caused adverse effects or failed to treat your condition. Your doctor can recommend alternative treatments and document any harm caused by the pharmacy’s error.

Once your health is secure, report the issue to the pharmacy. Speak with the pharmacist and ask how expired medication ended up in your hands. While the pharmacy may offer a replacement or apologize, this may not address the harm you’ve experienced. Make sure to document the conversation, keep all receipts, and preserve the expired medication and its packaging for future reference.

You may also want to file a complaint with your state’s Board of Pharmacy, which regulates pharmacies and investigates errors like dispensing expired drugs. If the incident caused you harm, such as worsening symptoms, a medical emergency, or financial losses from additional treatments, you should consult an experienced attorney. Pharmacy errors like this may constitute negligence, and you could be entitled to compensation for medical expenses, lost wages, and other damages.

Pharmacists have a legal and ethical obligation to ensure the medications they dispense are safe and effective. When they fail to meet this standard, patients have the right to seek justice. If you or a loved one has been harmed by expired drugs dispensed by a pharmacy, don’t hesitate to take action. Contact Kennedy Law Firm today for a free case review.
